Uniform Civil Code: Appeal Disposal within 60 Days

With the implementation of the Uniform Civil Code (UCC) in Uttarakhand, the responsibilities of officials and the process for registration and appeals have been clearly outlined. In case of delays in the registration process, applications will automatically escalate to higher authorities. Additionally, appeals against any orders must be resolved within 60 days.

Three-Level Process and Timelines

UCC Committee Chairperson Shatrughan Singh stated that the application process is divided into three levels: Sub-Registrar, Registrar, and Registrar General.

  • Sub-Registrar: Responsible for reviewing documents within 15 days for regular cases and 3 days for urgent matters.
  • If the Sub-Registrar fails to act on time, the application will automatically escalate to the Registrar.

Application and Appeal Process

  • If the Sub-Registrar rejects an application, the applicant can appeal to the Registrar.
  • If the Registrar fails to act, the case will move to the Registrar General.
  • Appeals at all levels must be resolved within 60 days.

Provisions for Invalid Marriages

The Sub-Registrar can declare a marriage invalid if:

  • The documents are forged.
  • The information is misleading.
  • The application is not submitted within the stipulated time.
    In such cases, the police will be notified, and penalties may be imposed for violations.

Applicability and Exceptions

The UCC applies to:

  • Residents of Uttarakhand.
  • Individuals residing outside Uttarakhand but holding domicile.
    Exceptions include:
  • Scheduled Tribes.
  • Individuals with protected cultural or religious practices.
