Waqf Amendment Bill: Property Details Must Be Published Online

The Joint Parliamentary Committee (JPC) has approved 14 amendments to the Waqf (Amendment) Bill, introducing significant changes aimed at ensuring transparency in the management of Waqf properties. One of the key provisions mandates that details of registered Waqf properties be published online within six months of the Act coming into force. The amendments also grant mutawallis (managers of Waqf properties) the right to extend their tenure based on the satisfaction of the Waqf Tribunal.

Key Changes Introduced

  1. Transparency Through Online Records: Registered Waqf property details must be publicly accessible on a dedicated website.
  2. Inclusion of Islamic Law Experts: An Islamic law expert will be included as the third member of the Waqf Tribunal.
  3. Protection of Disputed Properties: Declaring disputed properties as Waqf properties will now be restricted.
  4. Property Inspection by Authorities: Collectors or senior officials will have the authority to inspect Waqf properties.

Opposition’s Response

Opposition parties have supported retaining strict provisions in the Bill, arguing that excessive amendments might dilute its original intent and undermine its effectiveness.

Additional Provisions

  • At least two non-Muslim members must now be part of the Waqf Board.
  • Individuals must have adhered to Islam for a minimum of five years to declare any property as Waqf.

This amendment aims to address longstanding concerns about transparency and inclusivity while balancing religious practices with modern administrative needs.
