Uttarakhand: Consumer Commission Penalises Amazon and Seller ₹50,000 for Wrong TV Delivery

The District Consumer Disputes Redressal Commission, Almora, has imposed a ₹50,000 penalty on Amazon India Limited and the seller company for delivering the wrong television model to a customer. The Commission termed the incident an instance of unfair trade practice and directed both parties to compensate the consumer.

According to the order, Amazon and the seller must, within 45 days, either refund the purchase amount of ₹39,990 or, with the consumer’s consent, deliver the correct 55-inch TCL 4K Ultra HD Smart QLED TV that was originally ordered.

In addition, the Commission directed the opposite parties to pay ₹20,000 as compensation for mental harassment and ₹10,000 towards litigation expenses to the consumer.

The case was filed by Mrinal Verma, a resident of Almora, who had ordered a 55-inch TCL Smart TV from Amazon on July 12, 2025, for ₹39,990. However, when the product was delivered on July 17, he found that the package contained a 43-inch VW television instead of the model he had purchased.

Despite repeatedly requesting a replacement or refund through the online platform, the consumer did not receive a satisfactory resolution, prompting him to approach the Consumer Commission.

The Commission, comprising President Ramesh Kumar Jaiswal and members Vidya Bisht and Suresh Chandra Kandpal, ruled that the companies had indulged in unfair trade practices and directed them to deposit the ₹50,000 penalty with the Commission.

The order further states that if the directions are not complied with within the stipulated period, the refundable amount of ₹39,990 will also carry 8% annual interest, effective from September 26, 2025, until payment is made.
