The Nainital High Court has imposed a ban on khadiya mining in Bageshwar district, citing severe environmental damage and risks to local communities. The division bench issued this directive during a hearing on a suo motu public interest petition addressing cracks in villages caused by mining activities in Kanda Tehsil. The court has summoned the Director of Mining and the Industrial Secretary to appear personally on January 9, 2025.
Findings from the Court Commissioner’s Report
The Court Commissioner’s report revealed that mining operators have violated regulations by conducting illegal mining on forest land and government property. The activities have destabilized hillsides, increasing the risk of catastrophic landslides. The report, supported by photographic and video evidence, highlighted the gravity of the situation.
Villagers Demand Relocation and Permanent Mining Ban
Residents have reported large cracks in villages, temples, and hills caused by mining. These cracks worsen during rains, filling with water and escalating the risk of landslides. Agricultural lands have also been adversely affected. While some families have migrated to Haldwani, impoverished households remain trapped in hazardous conditions. Villagers are demanding a permanent ban on mining and their relocation to safer areas.
Court’s Orders
The court has directed the DFO Bageshwar, the Environmental Protection Authority, and the District Mining Officer to be made respondents and submit their responses. Two amicus curiae have also been appointed to ensure that the grievances of the affected villagers are addressed effectively.
